Moreoever, libel is defamation (knowingly making untrue statements about someone) that has occurred in a fixed form (usually writing). The word we use for verbal defamation in the US is “slander.” Also, slander is most certainly not what you are talking about either, because your point stems from the suggestion that harm should come to someone, not from untrue statements about him or her. This kind of speech could possibly bring about charges of tortuous negligence, or possibly even criminal negligence in the case that suggestions of harm were particularly egregious. In the worst cases, you could even be charged with conspiracy a la Charlie Manson.

Also, in regard to the existence of free speech in the US, we are indeed quite free. One cannot say “anything they want” because of the need for public safety (think of someone yelling “FIRE!” in a crowded movie theater). You are indeed free to say anything about anyone so long as it is not demonstrably untrue AND malicious. The specifics vary a little bit depending on whether you are a “public figure,” but in this case, we can all agree that O&A were not discussing “private persons.” This is most CERTAINLY a question of censorship – and we can debate the merits of censorship til everyone is blue in the face. Nevertheless, the ONLY recourse that any one of these listeners has to protest the censorship of O&A is to cancel their subscriptions. The media may decide that their actions were impetuous and some may dismiss them, but if these people took no action, no thought would go into whether suspending O&A was the right move. You can bet your a$$ that subscribers canceling their service concerns the executives at XM, and that’s PRECISELY what these people were going for.

RE: Destroying your radios. If O&A return to XM, you’ll look like idiots. If they don’t, you’ll still look like idiots. You’ve given the major media outlets a convenient way of dismissing you. Instead of being sympathetic towards you, the rest of the nation/world is going to think you’re as smart/relevant as Juggalos.

please make sure you have confirmation that your account is canceled. A lot of people (myself included) have been denied cancellation by XM. I have now been on the phone with them twice and my subscription has yet to be de-activated.
