Mass Effect had the same sort of uproar with it's 'sex scenes'. People who never played the game were completely against it, because they heard how bad it was from their friends who never played it either. As regarding to the whole points thing, I havn't noticed any such thing. If you drive drunk in-game, and a cop sees you, he will try to pull you over. Just like in real life.
