Apple hit with class action lawsuit over cracked iPhone 3G

This probably won’t come as a surprise to many of you, but Apple (and AT&T) has been hit with a class action lawsuit because of the cracks that develop in the iPhone 3G’s casing.

The lawsuit was filed in a Long Island court by a someone named Avi Koschitzki.

The suit also alleges that, in so many words, AT&T’s 3G network is a piece of garbage. Dropped calls, spotty 3G coverage often meaning you’re bumped down to EDGE because the 3G network is overloaded, etc. (Comedian Jim Norton often complains about AT&T’s network on Opie and Anthony. If it weren’t for the obscene profanity and possible copyright violations I’d post them here because they are insightful and do illustrate the type of problems people seem to be having with the network.)

We asked not too long ago if (m)any of you had run into problems with the iPhone cracking on you and there didn’t appear to be any definitive answer. (Owners of the black iPhone don’t tend to notice the cracks, for example.)

Who knows, maybe in a few years y’all will be able to claim 75 cents as part of a class action settlement.

  • What exactly is the goal for the people filing these class action lawsuits? Do they just want a few new iPhones? Can they not just go into an Apple store and get a new one because of the crack?

    The 3G issues are something I haven’t experienced and so I can’t comment on that, but a class action lawsuit over something like a crack is a bit silly when you can probably get a new one under the warranty. From what I’ve seen, Apple’s techs (at the Genius Bar I think) are pretty helpful and a little liberal with giving new ones if you’re having an issue. I heard about some others having issues and each one was given a new one when they took it in.

    If the lawsuit is over the 3G connection, what kind of damages are they going to show? That they spent $30/month and want it refunded? As I’ve seen with most iPhone users, they love the phone so much that they’ll put those aside and continue using it.

    My point: Are these folks doing this just to get some money out of it? Do we really not have something better to do? Clearly, I don’t, and so that’s why I’m criticizing people who actually do something, albeit wasteful.

  • Just noticed a crack on my white iPhone 3G. Will Apple replace this in their stores? Is it a covered item or they gonna say that it’s a user error, such as dropping it, etc.?

    Haven’t had a problem with 3G in Orange County, CA but the crack has just recently popped up. Want to get a replacement but don’t know if they will or not.

    • From my experience and from what others have told me, they’re a little liberal with replacing iPhones, maybe just to keep people happy even if the device doesn’t need to be replaced?

      My issue was that the browser crashed on me many times in a day. It was very irritating and so I took it in and they replaced it. Their system did notice the abnormal amount of crashes and the person helping me mentioned some other issue or something. I have a feeling that my issue was a software one because I usually had 7-8 browser windows open at the time.

      I’d take it over and see if they’ll help you out, maybe their diagnostic tools or whatever will pull up some other issue for which they need to swap it out, that happens from time to time.

  • My phone is crackin’ all over the place. I definitely will be pulling some strings to try and get a replacement if others have been successful.

  • i’d appreciate a switch out but don’t think they would. no subsidy on a return and thats a $400 subsidy. I’m kinda done with mine… too many safari and app crashes.

  • PATHETIC, GET A LIFE PEOPLE. DROPPED PHONE = CRACK. IF YOU CAN”T HOLD ONTO YOUR PHONE BECAUSE YOU HAVE BUTTER FINGERS THEN GET A CASE THAT WILL PROTECT IT FOR YOU. IT IS SO SAD TO HEAR THAT AMERICANS HAVE TO GO AS LOW AS THIS. I AM DISGUSTED TO HEAR SUCH NONSENSE. 3G IS NEW, ALL OF THE CARRIERS WILL HAVE ISSUES WITH IT UNTIL THEY CATCH UP ON GETTING ENOUGH TOWERS IN PLACE FOR THE DEMAND. GET A DAMN JOB AND PAY FOR YOUR OWN PROBLEMS, STOP DUMPING THEM OFF ON COMPANIES THAT WORK HARD TO KEEP SO MANY LOYAL CUSTOMERS HAPPY. LAWSUITS LIKE THIS MAKE ME SICK.

  • sorry michael… didn’t drop mine… lots of cracks due to the cheap plastic used in the chinese factories. Notice all the complaints of the new macbook pro’s too? no QA being done at these factories and with all these complaints on the white 3G’s, it’s apparent that it’s a bigger issue than originally talked about. and try typing in non caps.

  • i have the black 3G. no cracks. my girlfriend has the white 3G. no cracks. We both have covers on them, I don’t know if that makes a difference or not.

    as for the service. In Houston, it absolutely SUCKS! dropped calls over the place. sometimes it won’t even connect to the internet. we switched from Verizon, which had immaculate service….I guess it’s the price we pay to have a stupid phone. an amazing piece of technology, don’t get me wrong…Apple just chose the wrong network to partner with…

  • I read in January’s Consumer’s Report that certain states in America, especially the western states, that the AT&T service sucks ass so I would look it up in consumer’s report before switching to a phone company. Apparently though Verizon is suppose to be the best phone company out there but the AT&T in New York is pretty good compared to my company now which is T-mobile… And I WANT THE IPHONE 3G!!!! lol
